Article 1: General provisions

The e-commerce website of Berg in Box® (“seller”) a proprietorship with its registered office at Tiensestraat 54/2, 3000 Leuven, Belgium, VAT BE0672.752.903 provides its customers with the option of buying products from its webshop.

These General Terms and Conditions are applicable to all orders placed by a visitor to this e-commerce website (“Customer”). When placing an order via the webshop of Berg in Box®, Customer must explicitly accept these Terms, whereby Customer agrees to the applicability of these Terms with the exclusion of all other conditions. Additional Customer conditions are excluded, except when explicit accepted beforehand in writing by the seller.

Berg in Box® has the right to change these General Terms and Conditions from time to time. Any changes will apply as soon as they are published here.

Article 2: Price

All prices listed are expressed in EURO.
Shipping costs are clearly indicated separately on the website.
The specified price refers solely to the articles as set out in writing. The accompanying photos are intended as decorative and may contain elements that are not included in the price.

Article 3: Availability

Despite the fact that the online catalogue and e-commerce website are assembled with the utmost care, it is still possible that information may be incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the product selection are not binding for Berg in Box®. With respect to the accuracy and completeness of the provided information, Berg in Box® is solely bound to obligation of means. Berg in Box® is in no way liable in event of obvious material or printing errors.

If the Customer has specific questions about for instance sizes, colour, availability, delivery terms or method, the Seller asks the Customer to contact the customer service department in advance.
The product selection is valid while stocks last and may at any time be changed or withdrawn by the seller. Berg in Box® cannot be held liable for the non-availability of a product. If an offer is for a limited duration or subject to conditions, this will be explicitly stated in the offer.

Article 4: Online purchases

The customer selects a product and places it in the shopping cart. He selects “checkout” and enters his details for the shipment of the product. He then chooses the shipping method and then sees the payment information. After accepting the General Terms and Conditions, he can place the order (with payment obligation).

Berg in Box® is entitled to refuse an order pursuant to a serious breach on the part of the Customer with respect to their orders.

Article 5: Delivery and execution of the agreement

After his order, the Customer will receive a confirmation of his order by e-mail. As soon as payment has been received by Berg in Box®, the delivery period starts. When the product is shipped, the customer will receive another e-mail with the message that his purchased product has been shipped.

Items ordered through this webshop are delivered worldwide. The most common countries are in the shipping list. If a country is not included in the options in the shipping list, the Customer can send an email to the Seller to request the shipping rate.

For shipping, Berg in Box® works with various shipping companies, including DPD, DHL, PostNL and Bpost. Models are shipped with insurance against damage and loss. Exceptions are always possible. The standard delivery time for models is usually between 14 and 28 days. The delivery period for printed matter is usually 2 to 7 days. The stated delivery period is only an indication and is not binding. Exceptions are possible and Berg in Box® always tries to communicate these in time.

Any visible damage to and/or qualitative deficiencies of an article or other deficiency in the delivery must be reported by the Customer within 48 hours of receipt of the package by e-mail to kris(at)berginbox.be.

The risk due to loss or damage is transferred to the Customer at the time the goods have been physically received by the Customer (or a third party indicated by the Customer that is not the carrier). However, the risk transfers to the Customer upon delivery to the carrier when the carrier received the commission to transport the goods and this option was not offered by Berg in Box®.

Berg in Box® is never liable if the goods are damaged or lost during the transport process of the shipping company.

Article 6: Use, maintenance and data of the 3D models

The models are only suitable for indoor display. Outdoor weather conditions will have a negative impact on the quality of the model.
  • The model is not scratch resistant, both blunt and sharp objects will leave marks.
  • Prolonged exposure to direct sunlight can cause the colors to fade.
  • Remove dust with a soft brush or simply by blowing.
  • Wipe the wooden box with a soft cloth.
  • Do not use water to clean the model.
Due to increasingly accurate measurement techniques and rapid climate change, the height or location of some mountains, huts, etc. is changing faster than it can be adjusted on the boxes, printed matter and website. Berg in Box® makes an effort to be up-to-date as soon as possible, however is always dependent on the national geographic institutions for all data.

Since we work with untreated wood that is subject to environmental factors, it is possible that the box does not match the model perfectly.

Through a unique process we have managed to almost completely eliminate the typical layering of the 3D printing process. However, it is still possible that some print lines are visible in the model. This is inherent to the printing process and completely normal.

Since the models are not duplicates from a mould, but are constructed individually, it is possible that there is a minimal margin of error of 1 % on the scale.

Article 7: Retention of title

The delivered items remain the exclusive property of Berg in Box® until full payment has been made by the Customer.

The Customer undertakes, if necessary, to inform third parties of the retention of title of Berg in Box®, for example to anyone who would seize the articles not yet fully paid for.

Article 8: Right of withdrawal

The provisions of this article apply solely to Customers in their capacity as consumers purchasing articles online from Berg in Box®.

The Customer has the right to exchange or return the delivered articles from Berg in Box®, without stating a reason, within a period of 14 calendar days.

The withdrawal period expires 14 calendar days after the day on witch the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.

To exercise the right of withdrawal, the Customer must notify Berg in Box®, Tiensestraat 54/2, 3000 Leuven, Belgium in an unambiguous statement (e.g. in writing by post or e-mail) about their decision to withdraw from the agreement. The Customer may use the attached template withdrawal form, but it is not obligatory.

To comply with the withdrawal period, the Customer must send a notification of their decision to exercise the right of withdrawal before the withdrawal period has expired.

In any event, the Customer has no later than 10 calendar days from the day that they notify Berg in Box® of their decision to withdraw from the agreement to send back or hand over the goods to Berg in Box®, Tiensestraat 54/2, 3000 Leuven, Belgium. The Customer is on time if they have sent back the goods before the period of 10 calendar days has expired.

The direct costs for returning the goods shall be borne by the Customer.

The Customer is requested to return the articles in their original condition and packaging, with all accessories, printed matter and/or instructions for use supplied. If the returned product has lost value in any way, Berg in Box® reserves the right to hold the Customer liable and to claim compensation for any depreciation of the goods resulting from the use of the goods by the Customer going beyond what is necessary to determine the nature, characteristics and functioning of the goods.

All returned items are carefully examined. The starting point is that the consumer may only inspect the article as he would be allowed to do in a store. If a product has undergone a depreciation due to the use of the Customer or by not packing firmly enough for return to Berg in Box®, this will be charged to the Customer.

If the Customer revokes the agreement, Berg in Box® will refund the purchase price of the items and the shipping costs initially paid.
In the event of an exchange, Berg in Box® will pay the costs for resending a similar article once.
Any additional costs resulting from the Customer choosing another form of delivery other than by the cheapest standard delivery offered by Berg in Box® will not be refunded.

Berg in Box® shall repay the Customer using the same means of payment as the Customer used in the initial transaction, unless the customer explicitly agreed otherwise. In any case, the Customer will not be charged any costs in connection with such repayment.

The Customer may not exercise the right of withdrawal for:
  • The delivery of models or other articles manufactured or modified according to the customer's specifications;
  • The delivery of models that were personalized, for example by engraving an own chosen text in the wooden box;
  • The delivery of models or other articles that were personalized by adding specific routes, landmarks, texts, etc.
Article 9: Guarantee

The consumer has certain legal rights under the Act of 21 September 2004 concerning protection of consumers when purchasing consumer goods. This statutory guarantee applies from the date of delivery to the first owner. These rights remain in force irrespective of any commercial guarantee.

To make a claim under the guarantee, the Customer must provide some proof of purchase. Customers are advised to retain the original packaging used for the goods.

For articles purchased online and are delivered to the home of the Customer, the Customer must contact the Berg in Box® customer service and to return the product at their own expense to Berg in Box®.

Upon acknowledgment of the warranty claim, Berg in Box® will reimburse the customer for the shipping costs.

Upon detection of a deficiency, the Customer must inform Berg in Box® as soon as possible. In any case, any deficiency must be reported by the Customer within two months of detection. Hereafter, all rights to repair or replacement are voided.

The (commercial and/or statutory) guarantee are never applicable when there are deficiencies that arise as a result of accidents, neglect, falls, use of the product inconsistent with the purpose for which it was designed, failure to follow the operating instructions or manual, modifications or alterations to the article, rough usage, poor maintenance, or any other abnormal or incorrect use.

Deficiencies that manifest after a period of six months from date of purchase, or where applicable upon delivery, shall be deemed to not be hidden deficiencies, subject to contrary evidence provided by the Customer.

Article 11: Property right

The composition of the content of this website and the social media channels of Berg in Box® is the exclusive property of Berg in Box® and is protected by Belgian and international copyright laws. All content such as photos, logos, text and layout are the property of Berg in Box® and protected by Belgian and international copyright laws.

Article 12: Penalties for non-payment

Without prejudice to the exercise of any other rights that Berg in Box® is entitled to, the Customer owes interest at a rate of 10% per year on the non-paid amount in the case of non or late payment starting ipso jure on the date of the breach of contract and without notice. Furthermore, the Customer shall owe ipso jure a flat-rate compensation and without notice 10% of the pertinent amount, with a minimum of 25 euro per invoice.

Without prejudice to the foregoing, Berg in Box® is entitled to take back the unpaid or incompletely paid for articles.

Article 13: Privacy

The responsible party for processing information, Berg in Box® respects the Belgian law of 8 December 1992 regarding the protection of privacy in the processing of personal information.

The personal information the Client share with Berg in Box® is used only for the following purposes:
  • The proper processing and shipping of an order;
  • Sending a newsletter;
  • Creating an account in the webshop;
  • Informing about changes to the services and products.
The Client has a statutory right to access and eventually correct his personal information. Subject to proof of identity (copy of identity card), he may receive a free paper record of his personal information by sending a written, dated and signed request to Berg in Box®, Tiensestraat 54/2, 3000 Leuven, Belgium, kris(at)berginbox.be. If necessary, he can also request the correction of information that is inaccurate, incomplete or irrelevant.

In case information use for direct marketing purposes: the Client may preclude the use of his information for direct marketing purposes at no cost. To do so, he can always contact the Seller in the aforementioned manner at Berg in Box®, Tiensestraat 54/2, 3000 Leuven, Belgium, kris(at)berginbox.be.

Berg in Box® treats all personal information as confidential and shall not communicate, rent or sell it to third parties, unless legally obliged to do so.

The Customer is responsible for maintaining the confidentiality of their login information and the use of their password. The password is stored in encrypted form and thus Berg in Box® has no access to it.

Berg in Box® saves online (anonymous) visitor statistics in order to determine which webpages are accessed on the internet website and to what extent.

Article 14: Use of cookies

When the Client visits the website, “cookies” may be stored on the hard disk of the computer. A cookie is a text file that is placed by the server of a website via the browser on the computer or mobile device when accessing a website. Cookies cannot be used to identify individuals. A cookie can only be used to identify a device.
Berg in Box® uses:
  • “First-party cookies” are technical cookies used by the visited site itself and are intended to allow the website to operate in an optimal manner. Examples: settings specified by the user during previous visits to the site, or, a pre-filled form with data that the user entered during previous visits.
  • "Third party cookies": Google Analytics, to keep track of how visitors use the Berg in Box® website. Berg in Box® has entered into a processor agreement with Google to make agreements about the handling of the data. Furthermore, Berg in Box® has not allowed Google to use the obtained Analytics information for other Google services. Finally, all IP addresses are also anonymized.
The Client can set up his internet browser so that cookies are not accepted, or that he receives a warning when a cookie will be installed, or that the cookies will be deleted later from the hard drive. To do so, he must change the browser settings (via the help function). In doing so, the Client may prevent certain graphic elements from appearing correctly or prevent him from using certain applications.

If the Client uses the website, he agrees to the use of cookies.

Article 15: Invalidation - non-relinquishment

If any provision of these Terms is declared invalid, illegal or void, it shall in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by Berg in Box® to enforce any of the rights set out in these Terms, or to exercise any equivalent right, shall never be deemed as a waiver of such provisions and will never invalidate these rights.

Article 16: Amendments to the Terms

These Terms may be supplemented by other terms and conditions when explicitly referred to, and the general sales terms and conditions of Berg in Box®. In case of inconsistencies, the present Terms take precedence.

Article 17: Proof

The Customer accepts that electronic communications and backups shall serve as furnishing of proof.

Article 18: Applicable law - jurisdiction

Belgian law is applicable with the exception of the stipulations of private international law with respect to applicable law and with the exception of the Vienna Convention on the International Sale of Goods. Disputes will only be settled by a court in Belgium.
